USER TERM                          this term of use (''term of use") mandate the term on which user or visitors (''the user'') accessing the platform www.clicknowapp.in or mobile application clicknow (the platform) owned and operated by setmed health solution pvt ltd.                                                                           the platform may be used by user to avail clicknow service ,through either merchants registered with platform and delivery partners .       user carefully read the term of user before using the platform or registered on the platform. through continued use of the platform or accepting  this term of use at the time of creating   account , user accept this term of user and agree to be legally bound by the same.              1 ELIGIBILITY                                                          A .the platform the clicknow  are not avilable  to minors under the age of 18 years.                         B .clicknow reserve the right to refuse access to the platform at any time of new users or to terminate or suspended access granted  to existing  user at any time without any reason for doing so.                                                                                                                                                             2 .REGISTRATION                                                       A.  in order to use the platform  and avail the clicknow . user will have to registered on the platform create  an account with a unique user identity and password. user will be  required to enter their personal information including their name ,contact  detail, email address and valid phone number while registering an account.       3 CLICKNOW SERVICES                                           the platform provide the following service           1 it facilitates users to connect with merchant, service provider and delivery partners to view and  purchase products, service  listed on the platform by tied up merchant and there after allows user to have the purchased items delivered the delivery partners.                               2 it facilitates user to have packages picked up and dropped off from one location to other through delivery partners .                                       3 it facilitates users to avail the bike taxi service.                                                                       4 clicknow does not provide any guarantee that clicknow  service will be made available at all  time.                                                                             5 user here be agree and acknowledge the clicknow is only a marketplace and as such facilitates between user ,merchants, service provider, and delivery partners. clicknow is not a party to any of the transaction that are initiated between user , merchant , service provider , or delivery partner through the platform and clicknow shall not be liable for any manner or incur and liability with respect of the item, service , products offered and performed by the merchant or the delivery partners as the case may be  5. user here by acknowledge that clicknow shall not be liable for any damages of any kind arising from their use of clicknow service. 6. user here by agree that clicknow shall not be liable for any conduct or misbehaviour or action of delivery partners  with respect of any transactions  initiated on the platform. further user agree that clicknow has no control over the items or service provided by merchant and service provider. clicknow shall not be incur any liability with respect to such items.                         7 the product or service displayed on the platform are dependent on the availability of merchant ,service provider and delivery partner at the time of transaction.                                       8 clicknow service does not initiated for items which are illegal ,hazardous, dangerous or otherwise restricted or constitute items which are prohibited by ant statue or law and regulation.                                                                                                                                                                                                                                                4 PAYMENT TERM                                                     1. user shall pay such amount indicated on the platform with respect to the clicknow service aviled .                                                                           2. user agree that clicknow may use certain third party vendors and service providers, including payment gateway to process the payment made by user on the platform.               3. if user wish to cancel a transaction on the platform , they shall select the cancel  option  on the platform.it is to be noted that user may have a cancellation fee for transaction initiated on         the platform for which work has already been commenced by the delivery partner or the merchant , as the case may be.                                                                                                                   5 CANCELLATION AND REFUND                             1 if user wish to cancel a transaction on the platform ,they shall select the cancel option on the platform . it is to be noted that user may have a cancellation fee for transaction initiated on the platform  for which work has already been commenced for the delivery partner or the merchant .as the case may be .                          2.clicknow may cancel transaction initiated by user on the platform ,on the instruction of the merchant delivery partners .                                    a .the designated address provided by  user is outside the service zone of the merchant / service/delivery  partner.                                          b. there is no user response via phone or any other communication channel at the time of confirmation of the order booking.                        c. there is no user response involves supply/ service/ delivery /purchase any material good that is illegal , offensive , or violative of the term of use.                                                                       d. the user is not physically presents or it unreachable one delivery partner.                         e. if merchants outlet is closed.                            f. if any item or partners is not in stock with the merchant.                                                                  g. if a delivery partner is not available to perform the service.                                                                 h. if the transation cannot be completed for reason in control of clicknow.                                   3. user shall only be able to claim refund for transation initiated if they have already pre paid fee with respect of such transaction. subject to relevant merchant refund policy and in                     accordance therein.                                                 a. the package has been tampered or damage at the time of delivery.                                              b. if the wrong item has been delivered to user.      4. all decision with respect of clicknow and in accordance with clicknow internal policy .     REPRESENTATION AND WARRANTIES                     user agree and acknowledge that the use of the clicknow service offered by clicknow  is at their sole risk and clicknow disclaims representations and warranties of any kind.         INTELLECTUAL PROPERTY RIGHTS                        the trademarks ,logos and service marks displayed on platform are the property of clicknow .user are not permitted to use mark without the prior  consent  of clicknow.             DISCLAIMER OF WARRANTIES AND LIABILITIES                                                                  user expressly understand and agree that to the maximum permitted by applicable law.                   the platform clicknow provide service as is basis without of ant kind of warrenty .                  clicknow will have no liability related any user content arising under intellectual property.        clicknow  also disclaim  all liability with respect to the misuse , loss , modification  or unavailability of use content                                    PURCHASE SERVICE POLICY                                                                                                                       a general term and condition                                    in case of purchase service it is the duty of the tied up merchant or service provider to share an update of item list along with price on the platform. clicknow is not responsible for any            inaccurate item list on the platform.                 b. medicine purchase                                                 user purchase in any medicine or pharmaceutical medicinal product using the platform for which a valid prescription  from a registered medical practitioner is required will have upload  the corresponding prescription. it is the user responsibility to ensure that a clear copy of the valid copy of prescription is uploaded.                                                                    c. alcohol purchase                                                 a. in designated state  where   permitted facilitated the listing and sales of alcoholic beverages from tied up merchant having obtained the necessary licence.                           b. No refunds shall be provided by any order           placed  for alcoholic beverages once                     accepted   by the tied up merchant .                    c. User understand and confirm that alcoholic beverages procured from tied up merchant are sold as an in basis  and no complaint regarding the temperature . damage to the outer packaging or delayed delivery will be entertained.                                                                 d. If the user does not present physically or is unreachable once the delivery partner reaches the destinatinted delivery location for a period in excess of 15 minutes.clicknow reserve the right to unilaterally terminat the transaction with no refunds to the user .                                                    e. User understand that all alcoholic beverages procured by tied up merchant so delivery service provide or pickup service provide it depends on merchants.                                                                   TOBACCO PURCHASE                                               tobacco facilitate the listing and sale of tobacco or tobacco products by tied up merchant and the corresponding delivery by delivery partner to users that are over eighteen 18 years old.user also have appropriate proof of age at times of delivery.                                            PAYMENT TERMS.                                                      while initiating a request for a purchase service,user shall pay for the price of the platform once indicated on the platform upfront.the transaction of the purchase service will be initiated on the platform once the payment has been completed.in certain exceptional circumstances where the purchase price of the item is not available or where the user is offered alternate items when the original items not in stock.                                                      DELIVERY SERVICE POLICY.                                       the pnd service allow for users to connect with delivery partners to fulfill task raised by such users including. Task to purchase.pick up and drop items from tied up merchant location pickup location to drop location each a delivery task.                                                                              In using the delivery service,the users understand,agree, acknowledge and accept that.                                                                               a the delivery partner engaged with clicknow is no emloyer employee relationship between clicknow and the delivery partner.                           b. acceptance of a delivery task by a delivery partner shall constitute an independent contractual arrangements the service between users and delivery partner.                                     c. Clicknow is not responsible for any non performance or breach of any delivery task by the partner.                                                               d. Clicknow is not retail store, restaurant, food delivery service, service provider service, merchandise delivery service,a courier or shipping service or food preparation entity. Clicknow operates as online marketplace and does not at any point of time during any transaction hold any right, title or interest over the items being transported pursuant to any delivery task. e. The pick up location and drop location have been voluntarily added by the users on the platform and the user location data is collected in accordance with the term of use and privacy policy. f. users are aware of the items to be transported through a delivery task and that delivery task cannot be initiated for items which are illegal, hazardous, dangerous or otherwise restricted or constitutes items which are prohibited by any statuted or low or regulations.
